Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted in the patio area only between the hours of 12:00 Noon and 11:30 pm daily.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 5/12/15 and ABC-253 dated 5/12/15.

There shall be no dancing allowed on the premises.

There shall be no live entertainment permitted on the premises at any time.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated 5/12/15 and ABC-253 dated 5/12/15.

The sale of beer and/or wine for consumption off the premises is prohibited.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

The boundaries of this patio will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensee(s).

These barriers and boundaries shall not be changed without prior approval of the Department of Alcoholic Beverage Control.
