20 - OFF-SALE BEER AND WINE
Operating Restrictions:
Sales and service of alcoholic beverages shall be permitted only between the hours of 6:00 a.m. and 10:00 p.m. each day of the week.
The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.
Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.
Petitioner(s) shall regularly police the area under their control in an effort to prevent the loitering of persons about the premises as depicted on the most recently certified ABC-253.
No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.
There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.
No beer or wine shall be displayed within 5 feet of the cash register or front door unless it is in a permanently affixed cooler.
No display or sale of alcoholic beverages shall be made from an ice tub.
The petitioner(s) shall post and maintain a professional quality sign facing the premises parking lot(s) that read as follows: NO LOITERING, NO LITTERING, NO DRINKING OF ALCOHOLIC BEVERAGES VIOLATORS ARE SUBJECT TO ARREST The sign shall be at least two feet square with two inch block lettering. The sign shall be in English and Spanish.
The sale and delivery of alcoholic beverages shall be made to persons who are within the licensed premises only and not through a pass-out window, or a slide-out tray to the exterior of the premises. No alcoholic beverages shall be sold to any person while such person is in a motor vehicle. NO advertisement of alcoholic beverages shall be displayed on motor fuel islands, and no self-illuminated advertising for beer or wine shall be located on building or windows.
No beer or malt beverage products shall be sold, regardless of container size, in quantities of less than six per sale.
