The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

Any violations of the Alcoholic Beverage Control Act occurring at the areas outside the licensed premises as depicted on the most recently certified ABC-257, constituting grounds for suspension or revocation of the license shall be deemed to be the act and responsibility of all licensees therein licensed within the premises.

The licensee(s) or an employee of the licensee(s) will be present in or on the patio/terrace/other area at all times that alcoholic beverages are being served or consumed.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

Each licensee within the Culver City Project is responsible for ensuring signs shall be posted in a prominent place at each location marked on the most recently certified ABC-257 stating: "NO OPEN CONTAINERS OF ALCOHOLIC BEVERAGES BEYOND THIS POINT".

Petitioner(s) will only serve their alcohol beverages in containers which shall significantly differ in appearance from those containers utilized by any other licensees located in the Culver City Project. Said containers must display the name and licensee's business name.

Petitioner agrees to serve its alcoholic beverages in containers clearly distinguishable from non-alcoholic beverage containers.

Petitioner(s) and his/her/its employees shall be responsible to ensure that no patrons leave the Culver City Project with open containers of alcoholic beverages.

Sales, service and consumption of beer and wine shall only be allowed within the boundaries of the licensed premises on the ground floor of the premises and that portion of the patio area depicted on the most recently certified ABC-257.

Only the petitioner(s) or his/her its employees are allowed to sell or serve alcoholic beverages on the patio market on the most recently certified ABC-257.

Only patrons of this premises are allowed to consume alcoholic beverages purchased at this premises on the patio market on the most recently certified ABC-257.

When alcoholic beverages are being sold, served or consumed, employees or security personnel shall be assigned the responsibility of supervising the licensed premises as depicted on the most recently certified ABC-257. The petitioner shall be held accountable for any violations that occur in this area.

Employees or security personnel hired by the landlord or management of the premises building currently known as the "Culver City Project" shall be deemed agents of the licensee. Employees of all licensees therein shall be deemed agents of the petitioner.
