Petitioner agrees to serve its alcoholic beverages in clear containers that are distinguishable from non-alcoholic beverage containers. Said alcoholic beverage containers shall clearly and conspicuously display the name of the petitioner’s business.

The above listed licensee shall remain open for business at all times that alcoholic beverages are being consumed on the licensed premises, including the "common dining" area which were sold by the licensee.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The licensee(s) shall be responsible to provide policing/security within the "common dining" area at all times alcoholic beverages are being consumed on the licensed premises. security may consist of routine monitoring of security personnel provided by University Towne Center as well as employees of the licensee(s), whose responsibility will include the prevention of alcoholic beverages from being removed from the licensed premises, including the "common dining" area.

Signs will be posted and maintained at all entrances and exits prohibiting removal of alcoholic beverages from the area. Each sign will measure at least one foot by one foot square, with letters at least two inches in height.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio/terrace/other area, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.

Any violations of the law occurring on the licensed premises as depicted on the most recently certified ABC-257, constituting grounds for suspension or revocation of a license shall be deemed to be the act and responsibility of the petitioner(s).

The sale of alcoholic beverages for consumption off the premises is prohibited.
