Operating Restrictions:

Petitioner(s) shall not share any profits, or pay any percentage or commission to a promoter or any other person, based upon monies collected as a door charge, cover charge, or any other form of admission charge, including minimum drink orders or the sale of drinks.

Petitioner(s) shall not require an admission charge or a cover charge, nor shall there be a requirement to purchase a minimum number of drinks.

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 8:00 a.m. and 12:00 a.m. each day of the week.

Sales, service, and consumption of alcoholic beverages shall be permitted at the Duplicate 47 bar located between the bowling alleys, as depicted on the most recent ABC-257, between the hours of 8:00 a.m. and 12:00 a.m. each day of the week.

No noise shall be audible beyond the area under the control of the licensee(s).

During normal meals hours the premises shall be designed and used for and must possess the necessary utensils, table service, and condiment dispensers with which to serve meals to the public.

The petitioner(s) shall post a prominent, permanent sign stating, “NO LOITERING IS ALLOWED ON OR IN FRONT OF THESE PREMISES” in a place that is clearly visible to patrons of the licensed premises. The sign shall be at least two feet square with at least two inch block lettering.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensees as depicted on the most recently certified ABC-257 and ABC-253.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control as depicted on the most recently certified ABC-257 and ABC-253.

Petitioner(s) shall actively monitor the area under their control in an effort to prevent the loitering of persons on any property adjacent to the licensed premises as depicted on the most recently certified ABC-253.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

Between the hours of 6:00 p.m. and closing, the petitioner(s) shall provide at least one (1) uniformed, licensed security guard in the parking lot of the premises and two (2) uniformed, licensed security guards inside the premises on Sunday through Thursday, and at least (1) uniformed, licensed security guard in the parking lot of the premises and four (4) uniformed, licensed security guards inside the premises on Friday and Saturday, and shall maintain order therein and prevent any activity which would interfere with the quiet enjoyment of their property by nearby residents or the surrounding community. The licensed uniform security guard must be licensed by the State of California, Department of Consumer Affairs.

Petitioner(s) shall not require a minimum purchase of alcoholic beverages in any separate or segregated areas of the premises.

Alcoholic beverages shall only be served and poured by premises employees.

The sale of distilled spirits by the bottle for same day, or future consumption, is prohibited.

The smoking of tobacco products shall not be allowed within the area under the control of the licensee, as depicted on the most recently certified ABC-257.

The sale of alcoholic beverages for consumption off the premises is prohibited.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records, which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The licensee shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledges that incidental, sporadic or infrequent sales of meals or a mere offering of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.

Live entertainment shall end by 10:00 p.m. each day of the week. Live entertainment includes, but is not limited to, live music, disc jockey, karaoke, or fashion shows. Topless entertainment and mail or female performers shall be prohibited.
