Operating Restrictions:

Sales of alcoholic beverages shall be permitted only between the hours of 6:00 am and 10:00 pm Sunday through Thursday, and between the hours of 6:00 am and 12:00 am (midnight) Friday and Saturday.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 07/31/2019 and ABC-253 dated 07/31/2019.

There shall be an adequate number of signs posted prohibiting the consumption of alcoholic beverages on any property adjacent to the licensed premises under control of the licensee.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated 07/31/2019 and ABC-253 dated 07/31/2019.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of all other commodities during the same period. The licensee shall at all times maintain records which reflect separately the gross sales of alcoholic beverages and the gross sales of all other items of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

No coin operated amusement devices shall be maintained in the premises at any time.

The parking lot of the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the parking lot. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences.

All cups or containers shall be sold at or above prevailing prices and in their original multi-container packages or no less than 12. No empty cups or containers will be given away unless filled with the purchase of a non-alcoholic beverage.

The licensee(s) shall not sell and/or offer for sale or display any magazine, video or other printed material which contains pictures depicting: a. Acts or simulated acts of sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation or any sexual acts which are prohibited by law. b. Any person being touched, caressed or fondled on the breast, buttocks anus or genitals. c. Scenes wherein a person displays the vulva or the anus or the genitals. d. Scenes wherein artificial devices or inanimate objects are employed to depict, or drawings are employed to portray, any other prohibited activities described above.
