Operating Restrictions:

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated 07/13/2015 and ABC-253 dated 07/13/2015.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated 07/13/2015 and ABC-253 dated 07/13/2015.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 07/13/2015 and ABC-253 dated 07/13/2015.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

There shall be no pool tables or amusement machines in the premises at any time.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The licensee(s) or an employee of the licensee(s) will be present in the patios at all times that alcoholic beverages are being served or consumed.

The boundaries of these patios will be clearly defined and designated by physical barriers to separate it from the public side walk and adjacent private property which not under the exclusive control of the licensee(s). These barriers and boundaries, as approved and designated on 02/24/04 shall not be changed without prior approval of the Department of Alcoholic Beverage Control.

There shall be no use of any amplifying system or device in these patios.

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 8:00 a.m. and 12:00 Midnight each day of the week.
