Operating Restrictions:
The licensee(s) will erect and maintain sign(s) at all entrance/exits of the patio(s) prohibiting the removal of alcoholic beverages.
No alcoholic beverages shall be consumed on any property adjacent to the licensed premises, except the licensed patio, under the control of the licensee(s).
The licensee(s) or employee(s) of the licensee(s) will monitor the patio(s), at all times that alcoholic beverages are being served or consumed, to ensure that the premises will operate in compliance of all applicable laws and/or conditions.
The boundaries of this patio will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensee(s). These barriers and boundaries, as approved and designated on ABC-257, shall not be changed without proper approval of the Department of Alcoholic Beverage Control.
Any violation of the Alcoholic Beverage Control Act occurring in the licensed common area constituting grounds for suspension or revocation of a license shall be deemed to be the act and responsibility of the licensee herein.
If the Department of Alcoholic Beverage Control shall determine after hearing that said violation or violations were caused by another licensee, the said licensee named herein shall not suffer disciplinary action for said violation(s) as provided in Condition #1.
The licensed business must be operated as a bona fide public eating place in compliance with Section 23038 of the Business and Professions Code.
During business hours, an employee or security guard shall be assigned the responsibility of supervising the licensed common area. The licensee shall be held accountable for violations in this area.
Alcoholic beverages shall not be removed from the licensed common area and signs shall be posted to this effect at all entrances and exits of the licensed common area.
