Operating Restrictions:

The premises shall be regularly kept open and operated in a bona fide manner and make a real offer or holding out to sell and serve meals to guests for compensation.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The licensee(s) shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledge(s) that incidental, sporadic or infrequent sales or meals or a mere offering of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.

The premises shall be equipped and maintained in good faith and shall possess, in operative condition, such conveniences for cooking and storage of foods such as stoves, ovens, broilers, refrigeration or other devices, as well as pots, pans or containers which can be used for cooking or heating foods on the type heating device employed.

The premises shall possess the necessary utensils, table service and condiment dispenser with which to serve meals to the public.

The premises shall make an actual offer or holding out of sales of food to the public by such devices as menus, posters or signs.

The premises shall possess a supply of food and goods adequate to make substantial sales of meals.

During normal meal hours, the licensee(s) shall employ and use the services of adequate staff and employees for the preparation and service of meals, such as cook(s) and waitress(es).

Food facilities must be maintained in sanitary condition to comply with all the regulations of the local health department.

At all times during normal meal hours, during which the licensee(s) is/are exercising the privilege of the applied-for license, said licensee(s) shall offer meals consistent with what is customarily offered during said meal period. Normal meal hours are considered to be at least, but not limited to: Breakfast- 6:00 a.m. to 9:00 a.m.; Lunch- 11:00 a.m. to 2:00 p.m.; Dinner- 6:00 p.m. to 9:00 p.m.

The rear door(s) shall be kept closed at all times during the operation of the premises except in cases of emergency. Said door(s) not to consist solely of a screen or ventilated security door.

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 11:00 a.m. and 12:00 a.m. midnight.
