Operating Restrictions:
The licensee shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledges that incidental, sporadic or infrequent sales of meals or a mere offering of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.
During normal meals hours the premises shall be designed and used for and must possess the necessary utensils, table service, and condiment dispensers with which to serve meals to the public.
The quarterly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sales of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.
The sale of alcoholic beverages for consumption off the premises is strictly prohibited.
Any violation of the Alcoholic Beverage Control occurring in the common dining area constituting grounds for suspension or revocation of a license shll be deemed to be the act and responsibility of the licensee herein.
If the Department of Alcoholic Beverage Control shall determine after hearing that said violation or violations were caused by another licensee, the said licensee named herein shall not suffer disciplinary action for said violation(s) as provided in Condition #5 above.
During business hours, an employee or security guard shall be assigned the responsibility of supervising the common eating area. The licensee shall be held accountable for violations in this area.
The licensee(s) will erect and maintain signs at all entrances/exits of the common eating area(s) prohibiting the removal of open alcoholic beverage containers.
Alcoholic beverages purchased for consumption in the common eating area shall be served to the patron making the purchase by an employee of the premises only.
The boundaries of this common eating area will be clearly defined and designated by physical barriers to separate it from the public area and adjacent property which is not under the exclusive control of the licensee(s). These barriers and boundaries, as approved and designated on ABC-257, shall not be changed without proper approval of the Department of Alcoholic Beverage Control.
The licensee(s) or an employee of the licensee(s) will monitor the patio(s) at all times that alcoholic beverages are being served or consumed, to ensure that the premises will operate in compliance with all applicable laws and/or conditions.
No alcoholic beverages shall be consumed on any property adjacent to the licensed premises, except the licensed patio(s), under the control of the licensee(s).
The boundaries of the patio(s) will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensee(s). These barriers and boundaries shall not be changed without prior approval of the Department of Alcoholic Beverage Control.
The licensee(s) will erect and maintain signs at all entrances/exits of the patio(s) prohibiting the removal of open alcoholic beverage containers.
