Q. 118. Does the Act require alcoholic beverages
to be "Fair Traded"?
A. On May 30, 1978, the California State Supreme Court invalidated
the retail price maintenance provisions of the ABC Act dealing with distilled
spirits and beer. A subsequent decision handed down by the First District
Court of Appeal overturned similar provisions in the Act concerning sales
of wine to consumers. As a result, "Fair Trade" provisions with
respect to sales of alcoholic beverages by retailers are no longer a part
of state law.
